Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of Pane ("Service"), operated by Real Design, Inc. ("Company," "we," "us," or "our"), a Delaware corporation, at pane.money. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Pane is a hosted MCP (Model Context Protocol) server that connects your financial data to AI tools such as Claude, ChatGPT, Cursor, and other MCP-compatible services.
Eligibility
- You must be at least 18 years old to use the Service
- You must provide accurate and complete information when creating your account
- You must have the legal authority to link the financial accounts you connect through the Service
- You are responsible for maintaining the security of your account credentials and API keys
Description of Service
Pane provides the following functionality:
Financial Account Linking
You can link bank accounts, credit cards, investment accounts, and loan accounts through Plaid, a third-party financial data aggregator. Pane does not access your account credentials directly. Plaid handles all institution authentication.
MCP Endpoint
Once linked, your financial data is accessible through a personal MCP endpoint using API keys you generate. This endpoint can be connected to AI tools that support the Model Context Protocol.
Privacy Controls
You control what data AI tools can access through per-institution privacy scope settings (full, balances only, balances and redacted, or hidden). These controls are enforced before any data reaches MCP clients.
Web Dashboard
A web interface at pane.money for managing linked accounts, viewing financial data, configuring privacy settings, managing API keys, and handling billing.
Your Account
- You are responsible for all activity that occurs under your account, including any actions taken through your API keys
- You must notify us immediately if you believe your account or API keys have been compromised
- You may revoke API keys at any time through the web dashboard. Revocation takes effect immediately.
- You may delete your account at any time. Account deletion is immediate and irreversible, and permanently removes all your data as described in our Data Retention & Disposal Policy. This is distinct from subscription cancellation, which retains your data for 30 days to allow reactivation.
- One account per person. Do not create multiple accounts to circumvent usage limits or billing.
Financial Data and Third-Party Services
Plaid
By linking financial accounts, you authorize Plaid to access your financial data on your behalf and share it with Pane. Plaid's terms of service and end-user privacy policy apply to this data access. We request transaction, balance, investment, liability, and recurring transaction data. We do NOT request account numbers (auth) or personal identity information (identity).
AI Tools
When you connect your MCP endpoint to an AI tool, that tool will receive your financial data according to your privacy scope settings. Pane is not responsible for how AI tools process, store, or use your data once it leaves the MCP endpoint. You should review the terms and privacy policies of any AI tool you connect.
Stripe
Subscription billing is handled by Stripe. Your payment information is collected and processed entirely by Stripe. Pane never stores your payment card details. Stripe's terms of service apply to payment processing.
Data Accuracy
Financial data displayed in Pane and served through the MCP endpoint is sourced from your financial institutions via Plaid. Pane does not independently verify the accuracy, completeness, or timeliness of this data.
- Account balances, transactions, and other financial data may be delayed or incomplete depending on your institution
- Pane is not a financial advisor, tax advisor, or accounting service
- You should not rely solely on data from Pane for financial decisions. Always verify important information directly with your financial institutions.
- Spending summaries, categories, and insights generated by Pane or AI tools are informational and may contain errors
Acceptable Use
You agree not to:
- Link financial accounts you do not own or are not authorized to access
- Share your API keys with others or make your MCP endpoint publicly accessible
- Attempt to access other users' data or circumvent security measures
- Use the Service to facilitate fraud, money laundering, or any illegal activity
- Reverse-engineer, decompile, or attempt to extract source code from the Service
- Exceed rate limits (60 requests/minute per user on the API, 30/minute and 1,000/day on MCP) through automated or manual means
- Resell, sublicense, or redistribute access to the Service without written permission
- Use the Service in a way that could damage, disable, or impair it, or interfere with other users' access
Billing and Subscriptions
Plans and Pricing
Pane offers subscription plans with different feature sets. Current pricing is displayed at pane.money. Prices may change with 30 days' notice. Changes do not affect the current billing period.
Billing Cycle
Subscriptions are billed monthly in advance. Your billing cycle begins on the date you subscribe and renews on the same date each month.
Cancellation
You may cancel your subscription at any time through the web dashboard. Cancellation takes effect at the end of the current billing period. Your data is retained for 30 days after cancellation to allow reactivation. After 30 days, all data is permanently deleted. Note: cancellation is different from account deletion, which permanently removes all data immediately.
Refunds
Subscription fees are generally non-refundable. If you believe you were charged in error, contact [email protected] within 30 days of the charge.
Failed Payments
If a payment fails, we may retry the charge according to Stripe's retry schedule. Your subscription status will reflect the payment state (past_due, unpaid). Continued failure may result in suspension or cancellation of your subscription.
Intellectual Property
- Pane and its original content, features, and functionality are owned by Real Design, Inc. and protected by applicable intellectual property laws
- Your financial data remains your data. We claim no ownership over your financial information.
- You grant us a limited license to access, store, and transmit your financial data solely to provide the Service as described in these Terms
- This license terminates when you delete your account or unlink the relevant financial institution
Service Availability
We aim to keep Pane available and reliable, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:
- Scheduled or unscheduled maintenance
- Third-party service outages (Plaid, Stripe, hosting providers)
- Financial institution connectivity issues
- Factors beyond our reasonable control
We will make reasonable efforts to notify you of planned maintenance that may affect the Service.
Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms to the extent caused by circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of God, pandemics or epidemics, war or terrorism, cyberattacks or security incidents affecting infrastructure providers, government actions or regulations, labor disputes, power or internet outages, or failures of third-party services (including Plaid, Stripe, or hosting providers). We will make reasonable efforts to mitigate the impact and resume normal operations as soon as practicable.
Limitation of Liability
To the maximum extent permitted by law:
- Pane is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement
- Real Design, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or financial loss resulting from your use of the Service
- Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve months preceding the claim
- We are not liable for actions taken by AI tools based on financial data received through your MCP endpoint
- We are not liable for inaccurate, delayed, or incomplete financial data provided by your institutions through Plaid
Indemnification
You agree to indemnify and hold Real Design, Inc., its officers, directors, employees, and agents harmless from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:
- Your violation of these Terms
- Your use of the Service
- Your connection of the MCP endpoint to third-party AI tools
- Any unauthorized access resulting from your failure to secure your account or API keys
Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Informal Resolution
Before initiating any formal dispute resolution, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.
Binding Arbitration
If we cannot resolve a dispute informally, you and Real Design, Inc. agree to resolve any claims relating to these Terms or the Service through final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration will be conducted in English. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction. Either party may seek interim or preliminary injunctive relief from a court of competent jurisdiction in Delaware as necessary to protect the party's rights pending completion of arbitration.
Class Action Waiver
YOU AND REAL DESIGN, INC. AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.
Exceptions
Notwithstanding the above, either party may bring an individual action in small claims court for disputes within that court's jurisdiction. Nothing in this section prevents either party from seeking injunctive or other equitable relief for intellectual property infringement or unauthorized use of the Service.
Opt-Out
You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first accepting these Terms. If you opt out, disputes will be resolved in the state or federal courts located in Delaware.
Termination
- You may terminate your account at any time by deleting it through the web dashboard
- We may suspend or terminate your account if you violate these Terms, engage in prohibited activities, or if required by law
- We may discontinue the Service entirely with 30 days' notice. In this case, you will receive a pro-rated refund for any unused portion of your current billing period.
- Upon termination, all your data is permanently deleted as described in our Data Retention & Disposal Policy.
- Sections that by their nature should survive termination will survive, including Limitation of Liability, Indemnification, Dispute Resolution and Arbitration, and Governing Law
Privacy
Your use of Pane is also governed by our Privacy Policy and Data Retention & Disposal Policy, which describe how we collect, use, and protect your data. By using the Service, you consent to the practices described in those policies.
Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the Service or via email at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you should stop using the Service and delete your account.
Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Subject to the Dispute Resolution and Arbitration section above, any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Delaware.
Assignment
We may assign or transfer these Terms, and any rights and licenses granted hereunder, in whole or in part, without restriction and without notice or your consent, including in connection with a merger, acquisition, reorganization, or sale of assets. You may not assign or transfer these Terms or any of your rights or obligations hereunder without our prior written consent.
Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by us to be effective.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. If the class action waiver in the Dispute Resolution section is found to be unenforceable, the entire Dispute Resolution and Arbitration section shall be void.
Entire Agreement
These Terms, together with our Privacy Policy and Data Retention & Disposal Policy, constitute the entire agreement between you and Real Design, Inc. regarding the Service. They supersede any prior agreements or understandings.
